President Biden Issues a Memorandum on Extending Eligibility for Deferred Enforced Departure for Liberians 

President Biden issued a Memorandum on Extending Eligibility for Deferred Enforced Departure for Liberians to the secretaries of state and homeland security that defers through June 30, 2026, the removal of any Liberian national, or person without nationality who last habitually resided in Liberia, who is present in the United States and who was under Deferred Enforced Departure (DED) as of June 30, 2024. It also defers the removal of any Liberian national, or person without nationality who last habitually resided in Liberia, who has been continuously physically present in the United States since May 20, 2017. In addition, President Biden continued through June 30, 2026, employment authorization for individuals included in these categories. We will publish a Federal Register notice as soon as possible to implement the president’s memorandum.

Extension of the Designation of Syria for Temporary Protected Status

The Department of Homeland Security has extended the Temporary Protected Status (TPS) designation for Syria for 18 months from October 1, 2019 through March 31, 2021. The extension allows currently eligible TPS beneficiaries to retain TPS through March 31, 2021, so long as they otherwise continue to meet the eligibility requirements for TPS. The 60-day re-registration period runs from September 23, 2019 through November 22, 2019. Given the timeframes for processing TPS re-registration applications, USCIS has automatically extended the validity of certain Employment Authorization Documents (EADs) issued under the TPS designation of Syria through March 28, 2020. For more information regarding the TPS designation for beneficiaries from Syria, please refer to 84 FR 49751, dated September 23, 2019. For purposes of assessing compliance with the REAL ID Act, please note that there is no definite end to the period of authorized stay for Temporary Protected Status (TPS) beneficiaries who present a Form I-766, Employment Authorization Document (EAD) that contains a Category Code of A-12 or C-19 and a “Card Expires” date from the list below. 07/05/2016 07/22/2017 11/02/2017 01/05/2018 01/22/2018 03/09/2018 06/24/2018 07/05/2018 11/02/2018 01/05/2019 04/02/2019 06/24/2019 07/22/2019 09/09/2019 01/02/2020 01/05/2020 03/24/2020 An EAD that meets the above description is valid documentary evidence of TPS required by the Real ID Act of 2005, Section 202(c)(2)(B)(vii) and is acceptable for REAL ID purposes. Although the SAVE response provides a designation end date for TPS, these individuals do not have a definite end to the period of authorized stay. Pursuant to Section 202(c)(2)(C)(ii) of the Real ID Act of 2005, a temporary driver's license or temporary identification card issued to individuals who have a pending or approved application for TPS “shall be valid only during the period of time of the applicant's authorized stay in the United States or, if there is no definite end to the period of authorized stay, a period of one year.”
“Northern Mariana Islands Long-Term Legal Residents Relief Act” Guidance for Certain Individuals Present in the Commonwealth of the Northern Mariana Islands (CNMI)

USCIS announced it will automatically extend parole, and employment authorization if applicable, for certain residents of the Commonwealth of the Northern Mariana Islands (CNMI). This specific extension of parole as authorized by law will provide relief while USCIS establishes procedures for obtaining the new CNMI Resident status, which was created by the Northern Mariana Islands Long-Term Legal Residents Relief Act (PDF) (Public Law 116-24), signed by President Trump on June 25, 2019.
