President Biden Issues a Memorandum on Extending Eligibility for Deferred Enforced Departure for Liberians
President Biden issued a Memorandum on Extending Eligibility for Deferred Enforced Departure for Liberians to the secretaries of state and homeland security that defers through June 30, 2026, the removal of any Liberian national, or person without nationality who last habitually resided in Liberia, who is present in the United States and who was under Deferred Enforced Departure (DED) as of June 30, 2024. It also defers the removal of any Liberian national, or person without nationality who last habitually resided in Liberia, who has been continuously physically present in the United States since May 20, 2017. In addition, President Biden continued through June 30, 2026, employment authorization for individuals included in these categories. We will publish a Federal Register notice as soon as possible to implement the president’s memorandum.
USCIS is replacing the currently issued sticker that extends the validity of a Form I-551, Permanent Resident Card (also known as a Green Card), with a revised Form I-797, Notice of Action, receipt notice of Form I-90, Application to Replace Permanent Resident Card.
Starting Jan. 6, 2021, USCIS will begin issuing the revised notice which will extend the validity of a Green Card for 12 months from the “Card Expires” date on the front of the Green Card. An expired Green Card, together with a notice extending its validity, is equivalent to a valid, unexpired Green Card that establishes identity and is evidence of lawful status for purposes of the REAL ID regulation at 6 CFR 37.11(c) and (g). Whenever a license or benefit applicant presents a Green Card, user agencies can verify an applicant’s Lawful Permanent Resident status by submitting a SAVE case with the applicant’s name, date of birth, and Alien number (A-number) from the Green Card they present.
SAVE can verify when a federal, state, or local government benefit or license applicant has received deferred action under Deferred Action for Childhood Arrivals (DACA). These applicants may present an unexpired Form I-766, Employment Authorization Document (EAD) in combination with an I-797 Extension Notice issued by USCIS showing that their deferred action has been extended for one year. This unexpired EAD must contain a Category code of C33 and be issued on or after July 28, 2020. SAVE user agencies may need to institute additional verification in these situations.
On Jan. 2, 2020, USCIS will dispose of SAVE records that are more than 10 years old, which are those dated on or before Dec. 31, 2009. SAVE users have until Dec. 31, 2019, to download case information from the Historic Records Report if they want to retain information about these SAVE cases.

The Department of Homeland Security (DHS) today announced a Federal Register notice (FRN) extending the validity of Temporary Protected Status (TPS)-related documentation for beneficiaries under the TPS designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan.
The notice automatically extends through Oct. 4, 2021, the validity of Employment Authorization Documents (EADs); Forms I-797, Notice of Action; and Forms I-94, Arrival/Departure Record (collectively, TPS-related documentation) for beneficiaries under the TPS designations for these six countries. The Notice also provides instructions to request a new EAD for beneficiaries who want a new EAD with an Oct. 4, 2021, expiration date.

The extension allows currently eligible TPS beneficiaries to retain TPS through May 2, 2022, so long as they otherwise continue to meet the individual eligibility requirements for TPS. The 60-day re-registration period runs from Nov. 2, 2020, through Jan. 4, 2021.

In an effort to prevent a lapse in employment authorizations for certain Liberians in the United States, on March 30, 2020, President Donald Trump issued a memorandum directing Department of Homeland Security (DHS) Acting Secretary Chad Wolf to extend the deferred enforced departure (DED) wind-down period for eligible Liberians through Jan. 10, 2021.
The Department of Homeland Security has extended the Temporary Protected Status (TPS) designation for Somalia for 18 months from March 18, 2020, through Sept. 17, 2021. The extension allows currently eligible TPS beneficiaries to retain TPS through Sept. 17, 2021, so long as they otherwise continue to meet the individual eligibility requirements for TPS. The 60-day re-registration period runs from March 11, 2020 through May 11, 2020.
Given the time frames for processing TPS re-registration applications, USCIS has automatically extended the validity of certain Employment Authorization Documents (EADs) issued under the TPS designation for Somalia through Sept. 13, 2020.
TPS beneficiaries presenting an EAD referenced in the Federal Register notice do not need to show any other document, such as an I–797C Notice of Action, to prove that they qualify for this extension. SAVE will be able to verify the continuation of an applicant’s TPS using their recent TPS-related document along with their A-Number or I–94 number.

The 60-day re-registration period runs from March 2, 2020 through May 1, 2020.

The TPS-related documents are being extended in compliance with the preliminary injunctions of the U.S. District Court for the Northern District of California in Ramos, et al. v. Nielsen, et. al. and the U.S. District Court for the Eastern District of New York in Saget, et. al., v. Trump, et. al., and with the order of the U.S. District Court for the Northern District of California to stay proceedings in Bhattarai v. Nielsen. While the court orders remain in effect, TPS beneficiaries under the designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan retain TPS so long as they otherwise continue to meet the eligibility requirements for TPS.
